As reported by vnunet.com, it seems that Oracle and SAP were unable to reach an agreement in Oracles lawsuit against SAP’s subsidiary TomorrowNow.

This included establishing a centre dedicated to downloading Oracle’s technical information, along with a customised software tool called Titan that was programmed to bypass customer log-in restrictions.

Talk about "caught red-handed".  If there is evidence that you put time into developing an application to steal information and documentation, I would think that it would be a pretty difficult defense.
